12 Important U.S. Laws Every Blogger Needs to Know is a long article that merits your attention. The dozen legal issues are covered with a description of the issue, a summary of the law and a set of steps that will help you cover your behind. Really, print out the article and stuff it in your briefcase for that next long flight.

Today, I'm going to highlight the five legal issues that I think are most important.

1. Disclosing Bias. Although the heat is on people who accept money to make recommendations, the bias disclosure question is right on its heels. The prudent question is "When an employee takes up the company's cause in a private blog, is it bias?"

2. Deep Linking. In the legal world, this is how they talk about linking directly to an article rather than referencing the top level of the website that contains the article. In my opinion it is a bit of silliness designed to enrich lawyers but it's an issue worth watching. This is a copyright issue. The concern is that a reader may misunderstand the identity of an author. (In other words, sometimes it's hard to tell whose website you're on.)

3. Purloined Content. If you find that someone has used your work without your permission (and this might require a solid grasp of the RSS specification because you give people permission to use your content when you put it in RSS), always send a cease and desist letter.

4. User Content. It usually comes as a surprise to bloggers that they do not own the user generated content on their sites. The authors of each post or comment have instantaneous copyright protection for their work. The key to effective management of this issue is to have "terms of service" governing your ability to accept or reject comments based on a set of standards.

5. Duty to Monitor. The law protects bloggers from having to monitor and control slander or defamation. But, there are stringent requirements to monitor and control criminal comments or stolen intellectual property.

Blogging is maturing as we watch. Yesterday's fun and games are today's business policy issues. Grab the article and work through the implications.
