Outbound e-mails spell inbound legal trouble for corporations.
From The National Law Journal.
Outbound e-mail continues to be a big source of liability for employers, not to mention the legal headaches that message boards and blogs are causing, according to a new survey of more than 300 U.S. corporations.
In its fifth annual study of outbound e-mail and data loss prevention issues, Proofpoint, Inc., an e-mail security and data loss prevention company, found a number of legal threats that arise from corporate communications. The study found that companies are battling information leaks from outbound e-mail, as well as newer communications media such as blogs, message boards, media sharing sites and mobile devices.
Among the findings:
o More than one-third (34%) of large U.S. companies had employee e-mail subpoenaed by a court or regulatory body in the last year.
o 44% of companies investigated the leak of confidential or proprietary company data during that same time.
o More than a quarter, 26%, of U.S. companies terminated an employee for violating email policies in the last year.
o 41% of larger companies (those with more than 20,000 employees) employ staff to read or analyze outbound e-mail.
But e-mail is not the only source of risk for information leakage.
Respondents indicated significant risk also resulting from employee use of blogs, message boards and media sharing sites, such as YouTube. And mobile devices.
Some of the key findings include:
o 27% of companies investigated the exposure of confidential, sensitive or private information from lost or stolen mobile devices in the past 12 months.
o 11% of U.S. companies surveyed disciplined employees for improper use of blogs/message boards in the past 12 months.
o 13% disciplined employees for social network violations and 14% for improper use of media sharing .
